                        AN ORDINANCE TO AMEND CHATTANOOGA  CITY
                        CODE, PART II, CHAPTER 25,  WHICH CHAPTER
                        IS KNOWN AS "OFFENSES AND MISCELLANEOUS
                        PROVISIONS" BY INSERTING A NEW SECTION
                        25-34 RELATIVE TO THE PROHIBITION OF
                        SMOKING AND THE USE OF TOBACCO OR TOBACCO
                        PRODUCTS WITHIN THE CITY HALL BUILDING
                        AND THE CITY HALL ANNEX BUILDING.

              		WHEREAS, the City Council of the City of
              Chattanooga, Tennessee, is empowered to regulate all 
public
              grounds belonging to the City, and
             
              		WHEREAS, the City Council of the City of
              Chattanooga, Tennessee, is empowered to pass all 
Ordinances
              necessary for the health, convenience, safety and general
              welfare of the inhabitants of the City, and
             
              		WHEREAS, the City Council of the City of
              Chattanooga, Tennessee, is empowered to make regulations 
to
              secure the general health of the inhabitants and to 
prevent
              nuisances, and
             
              		WHEREAS,  the City Council of the City of
              Chattanooga, Tennessee, has declared that the smoking of
              tobacco and the use of tobacco and tobacco products in any 

              form is a public nuisance and dangerous to the public 
health,
              and
              		WHEREAS, the City Council of the City of
              Chattanooga, Tennessee, wishes to create certain "Tobacco
              Free Zones" in which the smoking of tobacco and the use of 

              tobacco and tobacco products in any form is prohibited, 
and
             
              		WHEREAS,  City Hall and the City Hall Annex, be and
              the same hereby, are declared "Tobacco Free Zones," 
wherein
              the smoking of tobacco and the use of tobacco and tobacco
              products in any form is prohibited.
             
                                     NOW, THEREFORE,
              		BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
              CHATTANOOGA, TENNESSEE,
             
              		SECTION 1.  That Part II, Chattanooga City Code,
              Chapter 25, be amended to add a new section as follows:
                       
                        "Section 25-34.  Prohibition of Smoking
                        in Public Buildings.

                        	It shall be unlawful for any
                        person to smoke tobacco or use tobacco or
                        tobacco products in any form in the
                        following public buildings:
                       
                        	(1)  City Hall
                        	(2)  City Hall Annex.
                       
                        	Anyone found guilty of violating
                        this Section shall be fined not less than
                        ten ($10.00) nor more than fifty dollars
                        ($50.00).
                       
              		SECTION 2.  BE IT FURTHER ORDAINED BY THE CITY
              COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, that this
              Ordinance shall take effect two (2) weeks from the date of 

              passage, as provided by law.
